Acceptance of Terms

By creating an account, accessing, downloading, or using SleepFlow, you agree to these Terms of Use and our Privacy Policy.

You may use SleepFlow only if you are legally permitted to enter into these Terms under applicable law.

SleepFlow is not directed to children under 13.

If you do not agree to these Terms, you should not access or use SleepFlow.

Your use of SleepFlow may also be subject to additional terms imposed by the platform through which you download or access the application, including Apple's App Store terms where applicable.

Description of Service

SleepFlow is a sleep and wellness application designed to help users better understand their sleep patterns and prepare personalized wind-down experiences.

Depending on the features available to you, SleepFlow may provide:

• sleep and recovery scores;
• nightly wind-down plans;
• adaptive sleep routines;
• routine components such as breathing, grounding, cognitive unload, relaxation, sound, reflection, and other supported activities;
• bedtime and sleep-window guidance;
• morning reflections;
• weekly sleep and routine insights;
• tracking-confidence information;
• personalized routine recommendations;
• SleepFlow Coach;
• research-informed explanations where available;
• observations about recent sleep and routine patterns.

SleepFlow may adapt parts of the experience using information you provide and your recent use of the product.

Features may change, be added, removed, limited, or updated over time. SleepFlow does not guarantee that every feature will always be available to every user, device, region, account, or subscription tier.

User Accounts

Certain SleepFlow features may require an account.

When creating or using an account, you agree to:

• provide accurate and reasonably complete account information;
• maintain the confidentiality of your account credentials;
• use your account only as permitted by these Terms;
• notify us if you become aware of unauthorized access or suspected account misuse;
• take reasonable responsibility for activity occurring through your account.

You may not impersonate another person or create an account using information you are not authorized to use.

We may suspend or restrict an account where reasonably necessary to protect users, SleepFlow, AVE Global LLC, or third parties, or where we reasonably believe these Terms have been violated.

Subscriptions & In-App Purchases

SleepFlow may offer premium features through subscriptions or other in-app purchases.

Purchases made through Apple's App Store or another supported application marketplace are processed by that platform and are also subject to that platform's applicable purchase and subscription terms.

Where an auto-renewing subscription is offered:

• subscription pricing and billing period will be displayed before purchase;
• subscriptions may automatically renew unless cancelled according to the applicable app-store subscription terms;
• subscription management and cancellation are handled through the platform where the subscription was purchased;
• refunds are subject to the policies of the applicable payment or app-store provider;
• available plans, features, and pricing may change over time.

Changing or deleting your SleepFlow account does not necessarily cancel an active third-party app-store subscription.

Users should separately manage subscriptions through the platform used to purchase them where required.

AI-Generated & Personalized Content

SleepFlow uses artificial intelligence, software rules, and personalization systems to generate or adapt parts of the user experience.

These features may include:

• nightly plan generation;
• selection or arrangement of supported routine components;
• routine duration;
• sound selection where relevant;
• personalized explanations;
• SleepFlow Coach responses;
• morning and weekly observations;
• possible contributors or patterns identified from available information.

By using these features, you acknowledge that AI-generated and personalized content may:

• be incomplete;
• contain errors;
• rely on incomplete or uncertain information;
• change as additional usable information becomes available;
• not reflect every factor affecting your sleep or how you feel;
• not always be appropriate for every individual situation.

Personalization may use signals such as:

• information you provide about tonight;
• preferences you provide;
• recent routine history;
• routine steps completed or skipped;
• routines shortened or changed;
• sounds selected or changed;
• explicit feedback;
• recent usable sleep and routine information.

SleepFlow does not guarantee that personalization will identify the best routine for you or improve any specific sleep outcome.

Personalized content should be treated as general wellness guidance rather than certainty about your health, sleep, or future outcomes.

Sleep & Wellness Disclaimer

SleepFlow is provided for general informational, sleep, and wellness purposes.

SleepFlow is not a medical device unless explicitly stated otherwise for a specific regulated feature.

SleepFlow is not intended to:

• diagnose a medical condition;
• provide medical treatment;
• cure or prevent disease;
• replace a healthcare professional;
• provide emergency medical services;
• determine the cause of a sleep disorder;
• guarantee improvement in sleep duration, quality, REM sleep, deep sleep, recovery, energy, or other health outcomes.

Sleep scores, Recovery Scores, tracking-confidence indicators, personalized routines, AI Coach responses, weekly patterns, and research-informed explanations should not be interpreted as medical diagnoses.

Sleep tracking may be incomplete or uncertain.

SleepFlow may use language such as:

• may;
• could;
• appears;
• possible contributor;
• recent pattern;
• research-informed;

Research-informed content means that a relevant explanation may be informed by reviewed scientific evidence. It does not mean that SleepFlow, a particular recommendation, or a personalized routine has been clinically proven to improve your individual sleep.

If you have concerns about your sleep, health, medication, or a medical condition, consult an appropriate qualified healthcare professional.

User Responsibilities & Prohibited Uses

You agree not to use SleepFlow to:

• violate applicable local, state, national, or international law;
• attempt to gain unauthorized access to SleepFlow, user accounts, infrastructure, or systems;
• interfere with or disrupt the operation or security of SleepFlow;
• reverse engineer, decompile, disassemble, or attempt to extract protected source code except where such restriction is prohibited by applicable law;
• use bots, scrapers, automated systems, or similar methods to improperly access or extract SleepFlow data or services;
• bypass security, access-control, subscription, or technical restrictions;
• misuse SleepFlow APIs or infrastructure;
• impersonate another person or misrepresent your identity;
• submit content designed to harm, disrupt, or compromise the service;
• reproduce, redistribute, resell, sublicense, or commercially exploit SleepFlow except where expressly authorized by AVE Global LLC;
• use SleepFlow in a manner that infringes the rights of others.

You remain responsible for how you choose to use general wellness information provided by SleepFlow.

Intellectual Property

SleepFlow and its related software, design, interfaces, visual elements, branding, logos, text, technology, algorithms, and other proprietary materials are owned by AVE Global LLC or its licensors and are protected by applicable intellectual property laws.

Subject to these Terms, AVE Global LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to use SleepFlow for its intended personal use.

Unless expressly permitted by AVE Global LLC or applicable law, this license does not allow you to:

• reproduce or distribute SleepFlow;
• modify or create derivative works from proprietary SleepFlow materials;
• resell or sublicense access;
• copy proprietary design or software elements;
• use SleepFlow trademarks or branding without permission.

Nothing in these Terms transfers ownership of SleepFlow intellectual property to you.

Third-Party Services

SleepFlow may rely on or interact with third-party services including providers for:

• cloud infrastructure;
• artificial intelligence processing;
• authentication;
• analytics;
• crash reporting;
• notifications;
• subscriptions and payments;
• platform services.

Third-party services may be governed by their own terms and privacy policies.

AVE Global LLC does not control every third-party service and is not responsible for third-party services beyond what is required by applicable law.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, SleepFlow is provided on an "as is" and "as available" basis.

AVE Global LLC does not warrant that:

• SleepFlow will always be available, uninterrupted, secure, or error-free;
• all sleep-tracking information will be complete or accurate;
• Sleep Scores or Recovery Scores will perfectly reflect how you slept or how you will feel;
• AI-generated or personalized content will always be accurate, complete, or appropriate;
• personalization will identify an ideal routine;
• SleepFlow will produce any specific health, wellness, sleep, recovery, or performance outcome;
• research-informed explanations apply equally to every individual;
• all defects or errors will be corrected immediately.

To the extent permitted by law, use of SleepFlow is at your own discretion and risk.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

Limitation of Liability

To the maximum extent permitted by applicable law, AVE Global LLC and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

• your use of or inability to use SleepFlow;
• reliance on AI-generated or personalized content;
• reliance on sleep scores, recovery scores, observations, or insights;
• interruption or loss of service;
• unauthorized access where liability may legally be limited;
• loss of data;
• decisions made based on general wellness information provided through SleepFlow.

SleepFlow does not guarantee specific sleep, wellness, health, academic, professional, or performance outcomes.

Nothing in these Terms limits liability where limitation or exclusion is prohibited by applicable law.

Account Termination

You may stop using SleepFlow at any time.

You may request deletion of your account according to the instructions available at Delete Account →

AVE Global LLC may suspend, restrict, or terminate access where reasonably necessary, including where we believe:

• these Terms have been materially violated;
• an account is being used fraudulently or unlawfully;
• use of the service threatens security or other users;
• continued access creates legal or operational risk.

Where appropriate and reasonably practicable, we may provide notice.

Termination does not automatically cancel an active subscription purchased through Apple's App Store or another external platform.

You may need to separately cancel an active subscription through the platform where it was purchased.

Sections of these Terms that by their nature should survive termination may continue to apply after termination.

Governing Law & Disputes

These Terms are governed by applicable law, subject to any mandatory consumer-protection rights that apply based on where you live.

AVE Global LLC is located in Colorado, United States.

Before starting a formal dispute, you may contact us at admin@aisleepflow.com so that we may attempt to resolve the issue informally.

Changes to These Terms

We may update these Terms of Use from time to time as SleepFlow, our services, or applicable requirements evolve.

If we make material changes, we may provide notice through:

• the SleepFlow application;
• the SleepFlow website;
• email;
• another appropriate method.

The revised Terms will display an updated effective date.

Your continued use of SleepFlow after revised Terms become effective may constitute acceptance of the updated Terms, subject to applicable law.

If you do not agree to updated Terms, you should stop using SleepFlow.
